Release of Liability, Waiver of Claims and Indemnity Agreement

1. Assumption of Risks

I am aware that snowmobiling involves inherent risks and dangers, including but not limited to changes in weather conditions, icy surfaces, terrain variations, avalanches, encounters with wild and domestic animals, the risk of contracting infectious disease, or collisions or impact with other participants, objects, or other persons, and accidents due to negligence, including the Organizer’s failure to safeguard me from the risks, dangers, and hazards referred to above.

I understand that communication on the alpine terrain can be difficult due to visibility and weather conditions and that medical treatment, evacuation, or rescue in case of an accident may not be available or may be delayed.

I expressly assume all risks and liabilities for loss, damage, death, or injury arising from the use, condition, and possession of the snowmobile obtained from the Organizer.

2. Participation in Training

I agree to participate in the mandatory training and instructions provided by the Organizer. I agree to follow the oral or written instructions given by the Organizer, tour guide and other representatives of the tour operator during the trip, and understand that my failure to do so may incur harm to myself and other participants.

3. Physical Fitness

I certify that I am physically fit and capable of participating in snowmobiling activities. I acknowledge that it is my sole responsibility to disclose any pre-existing medical conditions or injuries to the Organizer with sufficient notice.

4. Rules and Regulations

I agree to abide by all rules and regulations set forth by the Organizer and local guidelines. I understand that failure to comply may result in immediate termination of my participation in the activities.

5. Release of Liability

I hereby release, waive, and discharge the Organizer from any and all future liability, claims, demands, actions, or causes of action arising out of my participation in snowmobiling activities, including but not limited for any loss, damage, expense, or injury including death. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.

6. Indemnification

I agree to indemnify and hold harmless the Organizer from any loss, liability, damage, or costs, including legal fees, that may arise as a result of my participation in snowmobiling activities.

7. Damage to Rented Equipment

I agree that I am responsible for any damage to the snowmobile or additional equipment due to my negligence or carelessness and will have to pay the fixed fee of 1500 EUR where snowmobile insurance is available, or pay for the full damages in locations where snowmobile insurance is unavailable.

8. Damage to Third Parties

The Organizer or any person employed or contracted by the Organizer is not responsible for personal injury, death, or damage caused to my property or a third party’s property. The maximum amount of possible liability of the Organizer, a person employed by the Organizer or an entity or person otherwise contracted to the Organizer, to the customer or a third party is 50,000 EUR for personal injury and 10,000 EUR for property damage.

9. Photographic Release

I grant the Organizer permission to use photographs, video recordings, or other media of me for promotional or educational purposes.

In entering into this Release Agreement (Liability Waiver) I am not relying on any oral or written representations or statements made by the Organizer with respect to the safety of wilderness activities, other than what is set forth in this Release Agreement.

I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS LIABILITY WAIVER AND I AM AWARE THAT BY SIGNING THIS LIABILITY WAIVER I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE ORGANIZER.
